These Terms of Service (“Terms”) govern your access to and use of Sarvoty, a business communication and WhatsApp marketing platform operated by Infonubs (“Company,” “Sarvoty,” “we,” “our,” or “us”).

By accessing or using Sarvoty, you agree to be bound by these Terms. If you do not agree with these Terms, you should not access or use the Services.

1. Our Services

Sarvoty is a WhatsApp marketing and customer communication platform operated by Infonubs. Sarvoty helps businesses connect with customers, manage conversations, run WhatsApp marketing campaigns, and organize customer communication through the official WhatsApp Business Platform.

Depending on the services and features available to your account, Sarvoty may provide:

  • WhatsApp Marketing — Create and manage WhatsApp marketing campaigns using approved message templates.
  • Shared Inbox — Manage customer conversations from a centralized inbox and enable teams to handle customer communication efficiently.
  • Customer Management — Organize customer information using tags, attributes, sources, and conversation stages.
  • Audiences & Campaigns — Create and manage customer audiences for targeted WhatsApp marketing campaigns.
  • WhatsApp Message Templates — Manage approved WhatsApp message templates and use them for business communication and campaigns.
  • Multiple WhatsApp Connections — Connect and manage multiple WhatsApp Business Accounts and business phone numbers through Sarvoty.
  • Teams & Roles — Organize users into teams and manage access through role-based permissions.
  • Communication Automation — Use available automation features to streamline customer communication and reduce repetitive tasks.

Sarvoty is designed to provide businesses with a simple and affordable way to manage their WhatsApp marketing and customer communication from one platform.

Features, functionality, pricing, and service availability may be added, modified, suspended, or discontinued from time to time.

2. Eligibility

To use Sarvoty, you confirm that:

  • You are at least 18 years old.
  • You have the legal capacity to enter into these Terms.
  • You comply with applicable laws and regulations.
  • You are authorized to use Sarvoty on behalf of your business or organization, where applicable.
  • You have the necessary rights, permissions, and authorizations to use any business assets, customer information, phone numbers, or communication channels connected to Sarvoty.

3. User Accounts

Certain Sarvoty features require you to create an account.

You agree to:

  • Provide accurate and current information.
  • Keep your account information up to date.
  • Maintain the confidentiality of your login credentials.
  • Protect your account from unauthorized access.
  • Notify us promptly if you believe your account has been compromised.

You are responsible for activities performed through your account and for ensuring that your users comply with these Terms.

4. WhatsApp Business Platform

Sarvoty may connect with the official WhatsApp Business Platform and related Meta services.

Businesses are responsible for obtaining all required permissions and authorizations before connecting WhatsApp Business accounts, phone numbers, or other business assets to Sarvoty.

You agree to comply with applicable Meta and WhatsApp policies, terms, and requirements when using WhatsApp-related functionality through Sarvoty.

Sarvoty does not guarantee approval, availability, message delivery, or continued access to WhatsApp Business services where such functionality depends on Meta or other third-party services.

Changes, restrictions, suspensions, or termination imposed by Meta or WhatsApp may affect the corresponding Sarvoty functionality.

5. Wallet-Based Prepaid Model

Sarvoty may operate using a prepaid wallet-based billing model.

Where applicable, users may add funds to their Sarvoty wallet and use the available balance for eligible platform services and usage.

Charges may include, depending on the services used:

  • Platform usage
  • Communication-related usage
  • API usage
  • Campaign or automation usage
  • Infrastructure-related services
  • Other applicable service charges

Wallet balances are reduced according to applicable usage and pricing.

A Sarvoty wallet is provided solely for the use of Sarvoty Services. Wallet balances do not constitute a bank account, deposit, security, investment, or other financial asset.

Additional charges may apply for certain enterprise, infrastructure, implementation, or custom services.

6. Payments and Billing

You are responsible for maintaining sufficient funds where prepaid wallet functionality is used.

If your available balance is insufficient, certain services or usage may be restricted, paused, or interrupted until additional funds are added.

Pricing, applicable usage charges, and other fees may be communicated through the Sarvoty platform or applicable service documentation.

You are responsible for reviewing applicable pricing before using paid Services.

7. Acceptable Use

You agree not to use Sarvoty to:

  • Violate applicable laws or regulations.
  • Send spam or unauthorized communications.
  • Send fraudulent, misleading, abusive, or harmful content.
  • Use WhatsApp or other communication services in violation of applicable platform policies.
  • Attempt unauthorized access to Sarvoty or its infrastructure.
  • Circumvent security or access controls.
  • Upload malicious software or harmful content.
  • Interfere with the security, availability, or operation of the Services.
  • Use the Services for unlawful, fraudulent, or abusive activities.
  • Misuse APIs, automation functionality, or communication infrastructure.

You are responsible for obtaining all necessary permissions, consents, and lawful bases required to communicate with your customers or other recipients.

We may suspend or restrict accounts that violate these Terms or create legal, security, or operational risks.

8. User Data and Content

You retain ownership of the business data, information, content, and communications that you submit to or process through Sarvoty, subject to the rights necessary for us to provide the Services.

You authorize Sarvoty to process such information as reasonably necessary to:

  • Provide and operate the Services.
  • Process communications and workflows requested by you.
  • Maintain platform security and reliability.
  • Provide technical support.
  • Prevent abuse and unauthorized use.
  • Comply with applicable legal obligations.

You remain responsible for:

  • The accuracy and legality of information you provide.
  • Your customer communications.
  • Obtaining required permissions and consents.
  • Complying with applicable privacy and data protection laws.

9. Third-Party Services

Sarvoty may integrate with or depend upon third-party services, including:

  • Meta Platforms and WhatsApp Business Platform
  • Payment service providers
  • Cloud infrastructure providers
  • External APIs
  • Other integrations and service providers

Your use of third-party services may be subject to their own terms, policies, and requirements.

We are not responsible for outages, restrictions, policy changes, API limitations, account restrictions, or other issues caused by third-party services.

10. Service Availability

We make reasonable efforts to maintain reliable Services but do not guarantee uninterrupted or error-free availability.

Services may become temporarily unavailable due to:

  • Scheduled maintenance
  • Security updates
  • Infrastructure issues
  • Network failures
  • Third-party service interruptions
  • API changes or restrictions
  • Events beyond our reasonable control

11. Intellectual Property

Sarvoty, including its software, platform architecture, designs, interfaces, branding, trademarks, documentation, and proprietary technology, is owned by Infonubs or its applicable licensors.

Except as expressly permitted by us, you may not:

  • Copy or reproduce the Services.
  • Modify or create derivative works from the Services.
  • Reverse engineer or attempt to extract source code.
  • Redistribute or resell the Services.
  • Use Sarvoty branding without authorization.

Nothing in these Terms transfers ownership of Sarvoty intellectual property to you.

12. Suspension and Termination

We may suspend, restrict, or terminate access to the Services where reasonably necessary, including if an account:

  • Violates these Terms.
  • Violates applicable laws.
  • Violates applicable Meta or WhatsApp policies.
  • Engages in fraudulent or abusive activity.
  • Creates security or operational risks.
  • Attempts unauthorized access.
  • Fails to satisfy applicable payment obligations.

Upon termination, your right to access the affected Services may end.

Certain provisions of these Terms may continue to apply after termination where their nature requires continued application.

13. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided on an “as-is” and “as-available” basis.

We do not guarantee:

  • Continuous or uninterrupted availability.
  • Particular business results.
  • Revenue or sales outcomes.
  • Specific marketing performance.
  • Message delivery rates.
  • Approval or continued availability of third-party services.
  • Availability of Meta or WhatsApp Business Platform functionality.

Your use of the Services is at your own responsibility.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Infonubs and Sarvoty shall not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of the Services.

This may include, without limitation:

  • Loss of revenue.
  • Loss of business opportunities.
  • Business interruption.
  • Data loss.
  • Third-party service failures.
  • API restrictions.
  • Communication or message delivery failures.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

15. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable law, disputes arising out of or relating to these Terms or the Services shall be subject to the jurisdiction of the courts located in Narsinghpur District, Madhya Pradesh, India.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements, or other circumstances.

The updated version will be published on the Sarvoty website with a revised “Last Updated” date.

Your continued use of the Services after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
